These terms apply when you use this website or ask Emerson Tech, a Tennessee-based sole proprietorship ("we," "us," "Emerson Tech"), to perform repair or technology services. By using this site or requesting service, you agree to the terms below.
We provide computer and laptop repair, home network and Wi-Fi setup, smart home installation, data backup and recovery, printer and software setup, and small business IT support, as described on our Services page.
Pricing is as listed on our Pricing page unless we've agreed to something different with you in writing. For anything beyond a flat-rate Quick Fix, we'll tell you the likely cost before starting billable work. Payment is due at the time service is completed unless we've agreed otherwise.
Home Basic, Home Premium, and Business Pro are recurring monthly plans billed in advance on the same date each month starting from your signup date. Plans renew automatically each month until cancelled. You can cancel anytime by contacting us; cancellation takes effect at the end of the current billing period, and we don't provide refunds for the unused portion of a month already paid for. If a monthly payment fails, we'll reach out to update your payment method before pausing plan benefits — repeated failed payments may result in the plan being cancelled. Changing between tiers takes effect on your next billing date unless we agree otherwise.
By requesting service, you authorize Emerson Tech to diagnose and perform repair work on your device. YOU ARE SOLELY RESPONSIBLE FOR BACKING UP ALL DATA, SOFTWARE, AND FILES BEFORE SUBMITTING YOUR DEVICE FOR SERVICE. Emerson Tech does not guarantee the safety, integrity, or recovery of your data. Data loss can occur at any time during diagnostics or repair due to hardware failure, pre-existing issues, or software conflicts. BY DELIVERING YOUR DEVICE TO EMERSON TECH, YOU ACKNOWLEDGE AND AGREE THAT EMERSON TECH IS NOT LIABLE FOR ANY LOST, CORRUPTED, OR UNRECOVERABLE DATA, APPLICATIONS, OR CUSTOM SETTINGS, EVEN IF CAUSED BY OUR ACTIVE OR PASSIVE NEGLIGENCE.
We'll note any visible damage before starting work where practical. We are not responsible for pre-existing damage or conditions that were already present, including issues that only become apparent once a device is opened up or powered on.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EMERSON TECH'S TOTAL CUMULATIVE LIABILITY FOR ANY CLAIMS, DAMAGES, OR LOSSES ARISING OUT OF OR RELATED TO SERVICES PERFORMED SHALL BE STRICTLY LIMITED TO THE ACTUAL AMOUNT YOU PAID TO EMERSON TECH FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
IN NO EVENT SHALL EMERSON TECH BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF USE, LOSS OF DATA, OR THE COST OF RECOVERY OR RECREATING LOST DATA), EVEN IF EMERSON TECH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
If a device is left with us for repair and not picked up within 30 days of our notifying you that it's ready, we may consider it abandoned and dispose of it as permitted by law, to recover storage and labor costs.
Unless we state otherwise in writing at the time of service, repairs are provided to correct the specific issue diagnosed, without an additional warranty period. Parts we install may carry their own manufacturer warranty, which we'll pass along where applicable.
This website and its content are provided "as is." We try to keep pricing and information accurate and up to date, but we don't guarantee it, and we may update the site at any time. Please don't use this site in any way that could damage it or interfere with others' use of it.
These terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules.
We may update these terms from time to time; the effective date above will reflect the latest revision. Continued use of our services after an update means you accept the revised terms.
